Florida Habitual Traffic Offender Defense Lawyer
Accumulating three designated offenses within a five-year window triggers an immediate five-year Habitual Traffic Offender (HTO) revocation of your driving privileges under Florida Statute § 322.264.
For many Florida drivers, this five-year revocation comes as a complete shock. You might have mailed in a payment for what looked like a routine citation, only to receive a letter from the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) a week later stating that your driver's license has been revoked for five years.
Understanding the difference between criminal charges and civil infractions, and how simply paying a ticket constitutes an admission of guilt, can be the key to saving or restoring your license.

The Ticket Trap: Accidentally Triggering a Five-Year Revocation
This is the most common scenario that leads drivers into an HTO revocation.
- The citation: An officer pulls you over and informs you that your license is suspended. Because you were genuinely unaware, the officer issues a civil citation under § 322.34(1) with a fine (often around $166 depending on the county).
- Paying the fine: Thinking it is just an ordinary moving ticket, you pay the fine online or mail a check to put it behind you.
- The automatic conviction: Under Florida law, paying a civil traffic citation is an automatic admission of guilt and a formal adjudication of guilt (conviction).
- The revocation letter: Because paying the ticket entered an adjudicated conviction on your driving record, the FLHSMV counts it as your third strike within five years. Days later, a letter arrives notifying you that your license has been revoked for five years as a Habitual Traffic Offender (HTO).
How Golden Traffic Ticket Law Can Overturn an HTO Revocation
Receiving an HTO revocation letter does not mean all hope is lost. If your third strike was a civil traffic citation that you paid, the revocation can often be undone.
1. Filing a Motion for Reconsideration / Motion to Vacate
Under the Florida Rules of Traffic Court (Rule 6.490 / Rule 6.560), an attorney can file a motion asking the county traffic hearing officer or judge to reopen the case, vacate the conviction, and reconsider the disposition.
2. Securing a Withhold of Adjudication
At the hearing, our office argues for a modification of the conviction to a Withhold of Adjudication. Because civil infractions do not count as HTO strikes when adjudication is withheld, the strike is erased.
3. Dropping from Three Strikes to Two
Once the judge grants the withhold and enters the amended disposition, your count drops from three qualifying convictions to two.
4. Reinstating Your Driver’s License
We transmit the updated court disposition directly to the FLHSMV / Clerk of Court to remove the HTO designation from your record. Once the HTO flag is lifted, you can proceed to reinstate your valid Florida driving privilege, avoiding the five-year suspension and the need to wait a year for a restrictive hardship license.
The Florida Statutes Governing HTO & Suspended Licenses
To understand why your license was revoked, it helps to look at the exact Florida Statutes involved.
Florida Statute § 322.264 (The Habitual Traffic Offender Law): Defines an HTO as anyone who accumulates three or more convictions within five years for specific major driving offenses, most commonly:
- Driving While License Suspended, Revoked, or Canceled (DWLS)
- Driving Under the Influence (DUI) (§ 316.193)
- Driving Without a Valid Driver’s License (§ 322.03)
- Any felony in which a motor vehicle is used
- Leaving the scene of a crash involving injury or death
Florida Statute § 322.27(5): Requires the FLHSMV to revoke the driving privilege of an individual designated as a Habitual Traffic Offender for a mandatory period of five years.
Florida Statute § 322.34(2) (Criminal DWLS with knowledge): Driving while knowing your license is suspended is charged as a criminal misdemeanor (or felony for repeat offenses). Under Florida law, a criminal DWLS counts as a strike toward HTO even if the judge grants a "withhold of adjudication."
Florida Statute § 322.34(1) (Civil DWLS without knowledge): Driving while unaware that your license was suspended (for example, due to an unpaid toll, overdue child support, or a clerical lapse) is classified as a non-criminal civil traffic infraction.
The Withhold Rule: Why "With or Without Knowledge" Matters
The distinction between criminal DWLS and a civil infraction is critical when counting your "three strikes.”
- DWLS with knowledge: A criminal charge for driving with knowledge always counts as a strike toward the three-strike HTO threshold. Under Florida law, even if the presiding judge grants a withhold of adjudication, it is still classified as a conviction for HTO revocation purposes.
- DWLS without knowledge: A civil moving infraction does not carry the same mandatory penalty. If the court grants a withhold of adjudication on a civil DWLS, it does not count as a formal conviction and does NOT count as an HTO strike.
Time Is of the Essence
Courts enforce strict time windows for reopening traffic cases and filing motions for relief. The sooner you act after receiving notice of an HTO revocation or paying an underlying citation, the greater your chances of vacating the conviction and saving your license.

"Great Results"I had received a ticket during an accident. I contacted Golden Traffic Ticket Law offices. They explained the process and to be patient that the process did take time to go thru court system. They would update me periodically to let me know where in the process we were and if anything new had come up. I was then notified that the issue was clear up and no points, no community service and best of all no fine and no court costs. I would contact them again with out hesitation if I need them.- Tommy W
